A trend that has been emerging in recent years is the creation of "active-adult communities." These age-restricted, typically 55+, neighborhoods encourage participation and activity while providing homes that don't require lots of upkeep and maintenance. Residents of these communities are free to relax and live life to the very fullest.
Many question the legality of these types of neighborhoods - after all, the Fair Housing Act protects sellers and landlords from discriminating against potential home buyers and renters. However, did you know that age is not a protected class? Instead, the law prevents discrimination based on familial status. The Housing for Old Persons Act of 1995 (HOPA) circumvents this by providing exemptions to the familial status protection, and allowing an age-restricted community to exist if either:
- All occupants of the community are over the age of 62 OR
- At least 80% of occupied units include at least one resident who is over the age of 55, and the community follows a policy that demonstrates an intent to provide housing for 55+ residents.
